Trade Dispute Tribunal
OUR PROCESS & PROCEDURE:
- Registration and Planning of trade dispute:
- Trade Dispute has to be in prescribe forms
- Registration of the trade dispute & development of a plan to determine the case within 3 months
- Payment of fees
- Process of determination and making a decision:
- Notice issue to parties to attend conference or trial
- Conference is to outline the timeframe and what is expected from the party
- Filling of claim, defense, and counter claim
- Statements are filled
- Trial & decision
- Decisions is final
- Enforcement by the court
THREE (3) WAYS TO ACCESS OUR SERVICE.
- The Commissioner of the Department of Labor [COL]. The Commissioner will refer a Trade Dispute which she thinks cannot be solved within 7 days to the Trade Dispute Tribunal. A certificate of unresolved trade dispute and a report from her office will be submitted to the Trade Dispute Tribunal Office.
- The Minister of Internal Affairs [MOIA]. The Minister may refer a trade dispute to the tribunal. This trade dispute must involve an essential service for instance workers of an electricity company. The Minister may refer this to the Tribunal or the Commissioner of Labor for conciliation.
- The Court must refer any cases of trade dispute to the tribunal. A worker or an employer cannot directly access our services except through COL,MOIA &Court
